Apgar's only sanctioned reason for access to the victim's room and body was his religious office — he was there specifically to provide pastoral/spiritual care (prayer, singing) to a dying, unconscious patient. Arthur Earl Apgar, a chaplain working for a hospice service, pleaded no contest to four felony counts of sexual battery on an institutionalized victim. On December 4, 2025, the Honorable Michael Sweet sentenced Apgar to 5 years in state prison. The victim was unconscious and receiving hospice care in an elder care facility in August 2024 when Apgar, who had visited to pray and sing with her, was recorded on a family-installed camera sexually assaulting her; she died four days later.
