The appellate court itself grounded liability in 'his hierarchical position relative to the child' — the pastor's standing as community religious authority was the factor that (a) let him isolate the victim and (b) made her family's initial complaint be disbelieved by the community.

2023-11-22 · trial acquittal reversed on appeal; conviction ordered and imposed
Poder Judicial de Quintana Roo. A control judge initially acquitted the pastor in February 2022, characterizing the acts against a 12-year-old girl as consensual. The victim's mother appealed with support from the women's organization Mujer Libre MX Fuerza Ixchel. In December 2022 the appellate Penal Court found sufficient elements to establish responsibility for rape given the pastor's age and hierarchical position relative to the child, and ordered the control judge to issue a conviction. The control judge imposed the maximum sentence of 50 years in prison. The defendant filed a further appeal against the conviction.
Documented coercion mechanisms
- pastor's hierarchical/moral authority in a small community where he was regarded as unimpeachable
- community disbelief of the victim's mother because of the pastor's standing
