The court in Zwolle ruled that elders of a Jehovah's Witness congregation in the Northern Netherlands could not invoke a right of non-disclosure as clergy in the criminal investigation of a member (from Assen) accused of sexually abusing a minor, reasoning that when acting as members of a judicial committee handling an internal misconduct complaint, the elders were not functioning as spiritual counselors and so the privilege did not apply.
