Ireland: Ferryhouse Brother caught raping and drugging boys for four years is dismissed, not reported to Gardai — and when told directly, a Department of Education official decides 'no further action' is needed

   Ireland — Commission to Inquire into Child Abuse (Ryan Report, 2009), Vol. 2 ch. 3; a criminal prosecution of the same Brother followed 16 years later once a Garda investigation began independently. Br Bruno abused boys in Ferryhouse for roughly four years from the mid-1970s, selecting pubescent boys under his sole nighttime charge, sedating some with medication meant for bed-wetting, and repeatedly raping them; he told the Commission he abused 'dozens' and estimated 'over maybe 20, over a period of years'. Discovered in December 1979 after two absconding boys disclosed to Resident Manager Fr Stefano, Br Bruno confessed, was immediately removed and dismissed from the Order — never reported to the Gardai at that time. Fr Stefano, having consulted his Provincial, telephoned Department of Education official Mr Black early in 1980 to report a 'sexual assault on a pupil'; Mr Black told the Committee he was informed a Brother had been 'caught in bed with a boy' and was 'now on a train out of ... the place'. Mr Black consulted the Department Secretary, Mr Orange, who — after reflecting for a few moments — decided 'no further action was necessary' because 'the person responsible for the assault had been caught and was now removed from the School'. No written record was made by either official. Mr Black separately confirmed under questioning that he never asked Fr Stefano whether the matter had been reported to the Gardai. The Department's own Child Care Advisor likewise did not report the matter to Gardai, stating he had been told by Mr Black to 'leave it with him'. The Commission found that 'the Department of Education did not conduct any investigation into the events ... [n]or did the Department facilitate any such investigation, whether by the Garda Siochana, by the Department of Health, by the local Health Authority or by any other agency.' The matter surfaced 16 years later only because Gardai began an independent investigation after a former pupil was overheard discussing the abuse in public, not because of any report by the Rosminians or the Department; Br Bruno was convicted in 1999 on charges including buggery and indecent assault and sentenced to nine years with the final three suspended.

Documented coercion mechanisms

• sole, unsupervised nighttime control of a locked dormitory of 36-40 nine- to eleven-year-old boys, with private sleeping quarters attached
• routine administration of anti-bed-wetting medication, which Br Bruno himself controlled and used to select and sedate specific children before assaulting them
• fear and reputational control ('he had them terrorised') that suppressed reporting among the boys who witnessed or suspected the pattern for years
• an internal Church-to-State reporting channel (Resident Manager to Department official, by phone, with no note taken) that both sides treated as sufficient closure once the perpetrator had been removed from the building
