The authority is the defendant's claimed capacity to detect a porcha and to perform the rite removing it. The mechanism is distinctive: the rite was defined so that the victim's money was itself the object requiring treatment — it had to be 'cleansed' — which made surrendering her entire savings not a payment for the service but a constituent step of it. A victim who accepted the diagnosis had no coherent way to refuse the handover without abandoning the cure.

The defendant, anonymised in the published judgment as ФИО1, was convicted of fraud causing significant damage to a citizen under ч.2 ст.159 of the Criminal Code. The court found she approached the victim, a stranger, outside a shop and told her a curse had been placed on her and that removing it required her money to be 'cleansed'; the victim collected 26,000 roubles from her home, withdrew a further 195,000 roubles from her account at a Sberbank branch, and met the defendant, who led her to an area among garages and took the 221,000 roubles, handing back advertising leaflets prepared in advance to imitate banknotes. She was sentenced to 10 months 15 days' deprivation of liberty in a colony-settlement, with time in custody counted at one day for two, and remained in custody pending the judgment taking effect. The judgment records voluntary compensation of the loss as a mitigating circumstance, along with support for two children without independent income and care for a father with a group 2 disability. The prosecutor withdrew from the charge the investigation's characterisation of the victim as defenceless and helpless by reason of advanced age, on the ground that the case file contained no evidence supporting it; the court nonetheless treated the victim's advanced age as raising the offence's degree of public danger when assessing sentence.

The full text of the criminal judgment, read directly from the Russian judgments database sudact.ru. The court records that the defendant, «обманывая последнюю, сообщила, что на ней «наложена порча» и для снятия порчи необходимо «очистить» денежные средства», and «убедила Потерпевший №1 предоставить ей для проведения необходимого обряда все имеющиеся у нее в наличии денежные средства». The victim took 26,000 roubles from home and «со своего лицевого счета сняла принадлежащие ей денежные средства в размере 195000 рублей», then followed the defendant «к гаражам», where the defendant «под предлогом снятия порчи, завладела и тем самым похитила путем обмана... денежные средства в размере 221000 рублей, передав последней взамен похищенных денежных купюр, приготовленные заранее рекламные буклеты, имитируя денежные средства». The judgment also records that «государственный обвинитель... исключил указанную формулировку из обвинения, поскольку материалы дела не содержат доказательств того», in respect of the allegation that the victim was defenceless and helpless by reason of age, while stating that the offence carried «повышенную степень общественной опасности с учетом престарелого возраста потерпевшей». The operative part imposes «лишения свободы на срок 10 месяцев 15 дней с отбыванием в колонии-поселении».
