The claim did three things in sequence: it explained why the victim's gold had to leave her hands, it explained why a covered glass on the table should not be disturbed, and — in the instruction to drink the water only after the defendant had gone — it supplied the victim's own reason for letting her walk out. The court found the victim allowed her to leave unhindered because she believed the jewellery was in the glass. The rite did not merely conceal the theft; it recruited the victim into permitting it.

Kandalaksha District Court, Murmansk Oblast, Russia (Кандалакшский районный суд Мурманской области). The defendant was convicted of theft causing significant damage to a citizen under п.«в» ч.2 ст.158 of the Criminal Code. The court found that, in the flat of an elderly woman between 12:00 and 16:10, she decided to take advantage of the householder's advanced age; told her that a curse had been placed on her; and, under the pretext of removing it, persuaded her to hand over the gold chain with pendant and the gold wedding ring she was wearing. Having taken the items, worth 14,779 roubles in total, she set a glass of water covered with a bag on the table and told the victim that after she had gone the victim should drink the water and the curse would leave her. Believing her gold to be in the covered glass, the victim allowed her to leave the flat unhindered. She was sentenced to ten months' deprivation of liberty, and by full addition under ст.70 of the unserved part of a sentence imposed by a justice of the peace in Ivanovo Oblast, to a final sentence of ten months' deprivation of liberty together with a fine of 19,000 roubles, the custodial element being suspended under ст.73.

The court records that the defendant «решила воспользоваться престарелым возрастом Потерпевший №1 и похитить у нее ценное имущество», and that she «сообщила Потерпевший №1, что на нее наложена порча и под предлогом снятия порчи, убедила Потерпевший №1 передать ей имеющиеся при ней золотую цепочку с золотым подвесом и золотое обручальное кольцо». Having taken the items «на общую сумму 14 779 рублей», she «накрытый пакетом стакан с водой поставила на стол, пояснив, что после ее ухода, Потерпевший №1 должна выпить эту воду и с нее сойдет порча». The judgment continues: «Находясь под влиянием [защищено] и полагая, что в оставленном последней на столе стакане с водой находятся принадлежащие ей золотые изделия, Потерпевший №1 позволила [ей] беспрепятственно покинуть указанную квартиру». The operative part convicts under п.«в» ч.2 ст.158, imposes ten months' deprivation of liberty and, by full addition under ст.70 of an unserved sentence from a justice of the peace in Ivanovo Oblast, a final sentence of ten months together with a fine of 19,000 roubles, suspended under ст.73.
