2018-06-03 · conviction and sentence at first instance
Nizhnekamsk City Court, Republic of Tatarstan, Russia (Нижнекамский городской суд). The defendant, anonymised in the published judgment as ФИО1, was convicted of fraud by deception on a large scale under part 3 of article 159 of the Criminal Code of the Russian Federation and sentenced to four years' deprivation of liberty, suspended under article 73 with a four-year probation period. The court recorded that she had 'twice previously been convicted of the theft of the property of others by deception, by a group of persons by prior conspiracy, causing significant and large-scale damage to citizens', that 'after conviction she drew no proper conclusions for herself, did not take the path of correction', and that 'while serving suspended terms of punishment she again committed, by an analogous method, fraud by a group of persons by prior conspiracy causing large-scale damage'. It found she entered into a criminal conspiracy with a person whose case was severed, forming a criminal group, and that the two 'developed a plan for committing the offence, settling as the method of deception the presence of a curse and of deadly illnesses'. Sums recorded include 48,000, 26,460 and 484,000 roubles, with a total of 494,500 roubles assessed as large-scale damage.
Documented coercion mechanisms
- a plan developed with another person which specified the method of deception in advance
- the assertion that a curse was present and that deadly illness would follow
- commission of the offence while the defendant was serving two suspended sentences for the same conduct
