The authority is the claimed capacity to remove a curse, and this judgment is notable for how little it needed to obtain. Both victims were traders working their own stalls — a flower kiosk, a market pavilion — where a stranger stopping to talk is the ordinary business of the day and the trader cannot walk away. The claim converted that encounter into a request for whatever was to hand. What marks the second count is that the request did not stop at the woman's own jewellery: it extended to the dressing gown and jumper on her mannequins, the stock she was there to sell. Once the rite defines what it requires, there is no natural boundary at which the person being asked can say the object is not the right kind of object.

Naberezhnye Chelny City Court, Republic of Tatarstan, Russia (Набережночелнинский городской суд Республики Татарстан). The defendant, anonymised in the published judgment as ФИО2, was convicted on two counts of fraud causing significant damage to a citizen under ч.2 ст.159 of the Criminal Code. On 1 March 2016 between 17:00 and 17:30, at the 'Tsvetochny Ray' flower kiosk on the ground floor of a services building, she asked a trader she did not know for the gold items and money she had, under the pretext of removing a curse and knowing she would not return them; the trader handed over 1,000 roubles, a 583-standard woman's signet ring worth 15,000 roubles and 583-standard gold earrings worth 15,000 roubles, a loss of 31,000 roubles. On 1 April 2017 between 10:30 and 11:30, at pavilion S-4 of the 'Zarechye' wholesale-retail base, she made the same request of a second trader, asking not only for her gold but for a dressing gown and jumper hanging on the pavilion's mannequins; that victim handed over a 585-standard gold chain worth 10,000 roubles and a velour dressing gown worth 800 roubles among other items, a loss of 11,500 roubles. The court recorded in mitigation her state of health and that of her family, positive character references from her place of residence, and voluntary compensation — one victim in full, the other in part — and granted the outstanding civil claims for the remainder. She received two months on the first count and three months on the second, the lesser absorbed into the greater under ч.2 ст.69, giving a final term of three months' deprivation of liberty in a general-regime correctional colony.

On the first count the court records that the defendant, «находясь в павильоне «Цветочный рай»... путем обмана, под предлогом снятия «порчи» попросила у ранее незнакомой З. имеющиеся у нее золотые изделия и деньги, заведомо не собираясь их возвращать», the victim handing over «денежные средства на сумму 1000 рублей; печатку женскую из золота 583 пробы, стоимостью 15000 рублей, пару золотых сережек 583 пробы стоимостью 15000 рублей», a loss «на общую сумму 31000 рублей». On the second count, at «павильоне С-4 оптово-розничной базы «Заречье»», she «под предлогом снятия «порчи» попросила у Д. имеющиеся у нее золотые изделия, а также халат и джемпер, висящие на манекенах в павильоне, заведомо не собираясь их возвращать», the victim handing over «золотую цепочку 585 пробы, стоимостью 10000 ру[блей]» and «халат велюровый стоимостью 800 рублей», a loss «на общую сумму 11500 рублей». Mitigation recorded includes «состояние ее здоровья, членов ее семьи и близких, положительные характеристики с места жительства, добровольное возмещение ущерба (одной потерпевшей полностью, другой частично)». The operative part convicts on both counts under ч.2 ст.159 and imposes «три месяца с отбыванием наказания в исправительной колонии общего режима».
