Archive classification

This is the archive's application of its published inclusion test. The cited record appears below.

The authority here is asserted as a standing identity rather than improvised for one encounter: the court records that she presented herself as «гадалкой имеющей экстрасенсорные способности», a fortune-teller with extrasensory abilities, and offered a bundle of services — removal of porcha, removal of sglaz, and the healing of illnesses. That framing sustains a relationship rather than closing a single transaction, which is why the payments came «частями», in instalments across months. Four women accepted it from the same address. The structure is the same one the archive records in Naberezhnye Chelny and Prokopyevsk: where the practitioner claims a durable capacity rather than a one-off diagnosis, the taking extends over time and no individual demand is large enough to break the belief.

Proceedings

  1. 2017-06-07 · conviction and sentence at first instance

Kirovsky District Court of Makhachkala, Republic of Dagestan, Russia (Кировский районный суд г. Махачкалы). The defendant, anonymised in the published judgment as ФИО1, was convicted on six counts: four of fraud causing significant damage under ч.2 ст.159 of the Criminal Code, one of large-scale fraud under ч.3 ст.159, and one of open theft under ч.1 ст.161. The court found that at a single address she misled each victim by presenting herself as a fortune-teller possessing extrasensory abilities and, under the pretext of removing porcha and sglaz and healing illnesses, obtained money and gold from them with no intention of returning it. Against the first victim, between July and August 2016, she took 36,000 roubles in instalments together with gold including a chain worth 50,000 roubles and two rings worth 10,000 roubles each, a loss of 197,531 roubles. The other recorded losses were 25,000, 87,500 and 444,000 roubles. Sentences were two years on each ч.2 count, three years on the ч.3 count and one year on the robbery, aggregated by partial addition under ч.3 ст.69 to five years, and by further addition under ч.5 ст.69 with an unserved sentence of the Leninsky District Court of Dagestan of 19 July 2016 to a final term of five years six months in a general-regime colony. Under ч.1 ст.82 service of that sentence was deferred until her child reaches the age of fourteen. The civil claims of all four victims were granted, in the sums of 197,531, 25,000, 187,500 and 444,000 roubles.

Documented coercion mechanisms

  • an explicit claim to extrasensory powers — the court records her «представившись гадалкой имеющей экстрасенсорные способности» — rather than an ad-hoc assertion about a single curse
  • three services offered together: removal of porcha, removal of sglaz, and the healing of illnesses
  • payment taken «частями», in instalments over months rather than in one demand, so no single request was large
  • the property obtained on a promise of return the court found she never intended to keep
  • the same claim run against four victims from a single address, with one count escalating to open robbery
