Nadvirna District Court, Ivano-Frankivsk Oblast, Ukraine (Надвірнянський районний суд Івано-Франківської області). The defendant, anonymised in the published judgment as ОСОБА_3, was convicted of fraud under part 2 of article 190 of the Criminal Code of Ukraine and fined one hundred tax-free minimum incomes, being 1,700 hryvnia; the money bail she had posted, 22,940 hryvnia, was dealt with on the judgment taking effect. The court found that on 4 November 2011 the victim sought the defendant out in Nadvirna 'in order to learn about her future, since it had become known to her' that the defendant 'was engaged in telling about people's futures and could remove a curse by divination'. The two met on vul. Hrushevskoho and went together into a hospital building, where in the corridor the defendant, 'taking advantage of the trusting features of her character and friendly relations towards her', told her of a curse laid on her family and on her mother, and formed the intention to deceive her and obtain her money and other valuables.
Documented coercion mechanisms
- a local reputation that led the victim to seek her out
- the assertion that a curse had been laid on the victim's family and on her mother
- abuse of the confidence and friendly relations that followed
